13. Neither the Promoter or TNL shall be liable for any delay in performing or partial or total failure to perform any of its obligations to the winner under these terms and conditions if such delay or failure is caused by circumstances beyond its reasonable control including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation, war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes arising without limitation.

14. Neither the Promoter or TNL shall be liable to the winners for any loss or damage howsoever caused (whether in contract, tort or statutory duty or otherwise) arising out of or in connection with the competition and/or prize other than death or personal injury caused by negligence of the Promoter/TNL and/or the Promoter/TNL personnel and/or deceit or fraud by Promoter/TNL and/or Promoter’s/TNL’s personnel.

15. By entering the competition, entrants acknowledge that they may be required to be used in publicity without further consent or payment. Such publicity may include without limitation the entrant’s name and/or likeness, voice, photographs and/or video footage of the entrant, biographical information provided by the entrants/winner and/or any statement made by them concerning the competition and/or the prize. Entrants agree that any or all such elements may be used by the Promoter or TNL in any and all media in perpetuity throughout the world as the Promoter or TNL in its sole discretion sees fit.

16. The winning design will be used solely as the artwork on Crash, the limited edition version by JG Ballard set for publication in September 2008 by Harper Perennial. The Promoter and TNL reserve the right to publish entries other than the winning entry, and publication does not necessarily mean that the entrant has won a prize. The Promoter and TNL reserve the right to edit entries in its discretion for publication. Entrants will retain copyright in their submitted entries; however, by entering, all entrants give the Promoter and TNL a worldwide royalty free perpetual licence to edit, publish and use segments of each entry in any and all media (including print and online) for publicity and news purposes. In particular, all entrants license HarperCollins to use the artwork for the publication of Crash, the limited edition version by JG Ballard and TNL the right to print their entry on Times Online and in The Times or The Sunday Times or any of their supplements. The winning entrant will receive no monies for the use of their design on the aforementioned publication.

17. Any personal information, including without limitation, the entrant's name, address (including postcode), telephone number and/or email address will be used solely in connection with this competition and will not be disclosed to any third party, except for the purpose of fulfilling the prize where applicable. Any personal information held by the Promoter in respect of any competition will be held on record for a short period for the purpose of ensuring fulfilment of the competition and then destroyed unless the entrant has consented to the Promoter holding their personal information.

18. The winners may be required to submit valid identification before receiving their prize.

19. A list of winners for each competition can be obtained by sending a stamped addressed envelope together with details of the competition winners list you require to HarperCollins Publishers Limited, 77-85 Fulham Palace Road, London, W6 8JB within 30 days from the date of the closing date of such competition.

20. Entrants agree to be bound by these terms and conditions, which may be amended or varied at any time by the Promoter.

21. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and the courts of England shall have exclusive jurisdiction in relation to any disputes arising there from.
